What is the difference between a Gift Card, an eGift Card, and an eGift Certificate?

All Babe Label Gift cards, eGift Cards and eGift Certificates should be treated like cash: they cannot be replaced if lost, stolen, altered or destroyed. Babe Label Gift Cards, eGift Cards and eGift Certificates have no expiration date and cannot be redeemed or exchanged for cash (except as required by law). How do I check the Gift Card balance?

Online via Desktop Computer: Sign into your Account and click on your name for your account on the upper left-hand side of the page. From the My Account page, locate the Payments & Credits section and use the link to check your balance on the Gift Card.

A Babe Label Gift Card, eGift Card, or eGift Certificate should be treated like cash: they cannot be replaced if lost or stolen. Babe Label Gift Cards, eGift Cards, and eGift Certificates have no expiration date, are not charged any fees against the unused balance, cannot be redeemed or exchanged for cash (except as required by law). You can use up to two Gift Cards, eGift Cards and/or eGift Certificates per online order. You can use up to ten Gift Cards, eGift Cards, and/or eGift Certificates per online order by contacting Customer Service at 1-302-495-9471. If the amount of the order exceeds the amount of the Gift Card, eGift Card, or eGift Certificate, the recipient must pay for the balance of the order. If the amount of the order is less than the balance of the Gift Card, eGift Card, or eGift Certificate, the difference will be available to the recipient for future redemption. If any online credit is available to the recipient, then the online credit will automatically be applied first.

The daily exchange rate will determine the value of your Canadian Gift Card if used in U.S. and the value of your U.S. Gift Card if used in Canada.

 

How to Redeem a Babe Label Gift Card or eGift Card Online

Babe Label Gift Cards and eGift Cards have a 16-digit gift card code, and an 8-digit PIN number. To redeem online, just follow these easy steps:

Step 1 (for plastic Gift Cards only)

Using a coin or fingernail, scratch off the foil covering the 8-digit gift card PIN number. This is located on the back of the Gift Card, in the right corner.

Step 2

On the Checkout page in the Payment section, enter your Gift Card number and PIN number.*

Step 3

Hit the “Save & Continue” button in lower right corner of the Payment area. You will see the Gift Card amount deducted from your total order on the right side of the page.

*I entered my gift card information. Why is it still asking for my credit card?

Your Gift Card, eGift Card, or eGift Certificate may not cover the full order total, which can include sales tax, shipping fees, or the difference of the order. Gift/eGift card funds will be applied to your order total first, and any remaining amount will be covered by your credit card. On the Confirmation Order page, be sure to review the payment information and total charge of your order to confirm all details are correct.

Card Issuer

Babe Label Gift Cards, eGift Cards, eGift Certificates, and Promotional Cards issued in the U.S. are issued by the Gift Card Provider, which is the sole legal obligor to the cardholder. Neither Babe Label LLC. nor any of its subsidiaries or affiliates (including Babe Label Canada, Inc.) other than the gift card provider shall be liable to a cardholder with respect to Gift Cards, eGift Cards, eGift Certificates, and Promotional Cards issued in the U.S.

Babe Label Gift Cards, eGift Cards, eGift Certificates, and Promotional Cards issued in Canada are issued by Babe Label Canada, Inc. which is the sole legal obligor to the cardholder. Neither Babe Label, nor any of its subsidiaries or affiliates shall be liable to a cardholder with respect to Gift Cards, eGift Cards, eGift Certificates, and Promotional Cards issued in Canada.

Babe Label Gift Card and Promotional Card Terms and Conditions

The following Babe Label Gift Card and Promotional Card Terms and Conditions (“Agreement”) describes the terms and conditions that apply to use of Babe Label Gift Cards and Babe Label Promotional Cards (collectively, “Cards”) issued in the U.S. This Agreement is between you, the Cardholder, and Gift Card Provider. BY PURCHASING, ACCEPTING OR USING YOUR CARD, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE WITH THIS AGREEMENT, DO NOT PURCHASE, USE OR ACCEPT THE CARD.

IMPORTANT: THIS AGREEMENT INCLUDES RESOLUTION OF DISPUTES BY ARBITRATION INSTEAD OF IN COURT. PLEASE REVIEW THE PROVISIONS REGARDING ARBITRATION BEFORE PURCHASING, USING, OR ACCEPTING THE CARD.

1. Changes To Agreement

Our gift card provider reserves the right to change this Agreement from time to time in its discretion, which changes we may provide to you by any reasonable means, including without limitation, by posting the revised version of this Agreement at babelabel.com. YOUR CONTINUED USE OF THE AGREEMENT AFTER THE POSTING OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.

2. Balance Inquiry

For balance inquiry, email hello@babelabel.com. The balance you hear when inquiring over the telephone is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.

3. Expiration/Deactivation

Babe Label Gift Cards do not expire. Babe Label Promotional Cards may expire depending on the particular promotion; thus, please refer to the specific terms and conditions for your Promotional Card. No fees for inactivity or service fees apply. Our gift card provider reserves the right to refuse to honor any Card in the event of a disputed credit card charge, bounced check or other failure of consideration.

4. Redemption

A Babe Label Gift Card is redeemable for purchases of merchandise online at Babelabel.com, on the Babe Label mobile app, and at Babe Label Pop up Retail Stores.

5. No Refunds

NO REFUNDS ARE PERMITTED WITH RESPECT TO CARDS.

7. Lost, Damaged Or Stolen Card

The value of any lost, damaged or stolen Cards will not be replaced.

8. Limitation Of Warranties

The Gift Card Provider AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CARDS INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

IN THE EVENT THAT A CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CARD.

10. Agreement to Arbitrate Disputes

MANDATORY BINDING INDIVIDUAL ARBITRATION. Please read this section carefully. It affects legal rights that you may otherwise have and requires individual final and binding arbitration of most disputes instead of resolution in court.

Arbitration is the submission of a dispute to a neutral arbitrator, instead of a judge or jury, for a final and binding decision, known as an “award.” Arbitration provides for more limited discovery than in court, is subject to limited review by courts, and the result is confidential. Each party has an opportunity to present evidence to the arbitrator in writing or through witnesses. An arbitrator can only award the same damages and relief that a court can award under the law and must honor the terms and conditions in this Agreement.

1. ARBITRATION AGREEMENT, CLASS ACTION WAIVER, PUNITIVE DAMAGES WAIVER

You and the gift card provider agree that any dispute, whether at law or equity, arising out of or relating to this Agreement or your use of the Card, regardless of the date of accrual of such dispute, shall be resolved in its entirety by individual (not classwide or collective) binding arbitration, except that you or gift card provider may take claims to small claims court if they qualify for hearing by such a court.

You and gift card provider agree that any arbitration under this Agreement will take place on an individual basis and that class, mass, consolidated or combined actions or arbitrations or proceedings as a private attorney general are not permitted.

You and gift card provider agree to waive the right to trial by jury.

This agreement to arbitrate extends to claims that you assert against other parties, including without limit claims against Babe Label LLC, and its affiliates and related entities.

The Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate.

This agreement to arbitrate shall survive termination of this Agreement. Notwithstanding anything to the contrary, if any part of this agreement to arbitrate is deemed invalid or inapplicable, the remainder of the agreement to arbitrate shall still be considered valid and enforceable. If any part of this agreement to arbitrate is deemed invalid or inapplicable, you and gift card provider both waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class, mass, consolidated, or combined basis.

ARBITRATION PROCEDURES

Arbitration shall be conducted by JAMS in accordance with its Streamlined Arbitration Rules and Procedures (the “JAMS Rules”). The JAMS Rules and instructions for how to initiate an arbitration are available from JAMS at http://www.jamsadr.com or 1-800-352-5267. To begin an arbitration proceeding, you must serve gift card providers registered agent. Payment of all filing, administration and arbitrator fees will be governed by the JAMS Rules, except that for claims of less than $1,000, you will be obligated to pay $25 and the gift card provider will pay all other administrative costs and fees. In addition, for claims of less than $1,000, the gift card provider will reimburse you for the $25 fee if the arbitrator rules in your favor. Reasonable attorneys’ fees and expenses will be awarded only to the extent such allocation or award is available under applicable law.

Any arbitration will take place in or near the county where claimant resides and will be determined by a single arbitrator; provided, however, that upon request by either party, the arbitration shall be conducted via telephone to the extent permitted by the JAMS Rules. The arbitration may award on an individual basis the same damages and relief as a court (including injunctive relief).

Judgment on the award may be entered in any court of competent jurisdiction.

11. Choice of Law/Forum Selection

In any circumstances where the Arbitration Agreement permits the parties to litigate in court, this Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, excluding its conflict of law rules. You expressly consent and agree to submit to the exclusive jurisdiction and venue in Delaware.

12. Severability

The provisions of this Agreement are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by gift card provider, or alternatively, by disposition of an arbitrator or a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Agreement without affecting the validity, legality or enforceability of any of the remaining provisions.

13. Fraud

The gift card provider reserves the right to refuse to honor a Card where the gift card provider suspects that the Card was obtained fraudulently.
